OpenSky Terms of ServiceLast updated: 08-01-2025These Terms of Service govern your use of OpenSky, including our website, application, and services. By creating an account or using the platform, you agree to these terms. If you do not agree, you may not use OpenSky.
1. Who May Use OpenSky
You must be 18 years or older to create an account. By signing up, you confirm that you are a parent, legal guardian, or an authorized adult responsible for managing a student’s educational experience.
Parents or guardians are responsible for:
Creating and managing student accounts
Granting student login access
Supervising use of the platform
Ensuring any content submitted by a child is appropriate
If you are an educator or co-op leader using OpenSky on behalf of others, you must ensure that appropriate consent has been obtained from parents or guardians.
2. Student Accounts and Parental Consent
Parents may create student profiles, including for children under 13. These profiles may include names, grade levels, assigned courses, and progress tracking.
Students may be allowed to log in and:
View personalized checklists
Mark lessons complete
Submit reflections or notes
Upload work
By granting your child login access, you provide verifiable parental consent under the Children’s Online Privacy Protection Act (COPPA).
You may review or delete your child’s data at any time. To do so, email privacy@openskyplanner.com.
3. Uploaded Content
You own the original content you create and upload to OpenSky, such as lesson notes, assignments, schedules, student work, and other materials you have authored yourself.
OpenSky also allows you to upload and share factual or structured curriculum data (such as unit, chapter, and lesson titles, as well as their order) and your own annotations or recommendations. Structured curriculum data may be shared with others, provided it does not include substantial portions of copyrighted text beyond what is reasonably necessary to identify or describe the work. Long or highly creative titles should be paraphrased when possible.
If you upload copyrighted material for which you do not hold rights to share, you may store it in your account for personal use only. It will not be made accessible to other users.
By uploading any content, you grant OpenSky a limited, non-exclusive license to store, display, and process that content solely for the purpose of operating and improving the platform. We do not claim ownership over your materials and will never sell or share them without your explicit consent.
You are responsible for ensuring you have the rights or permission to upload and, if applicable, share any content. We comply with the Digital Millennium Copyright Act (DMCA) and reserve the right to remove or restrict access to any content alleged to infringe copyright.
4. Acceptable Use
You agree not to use OpenSky to:
Break any law or violate any regulation
Upload harmful, abusive, or explicit content
Upload, share, or distribute content that infringes on another person’s or organization’s intellectual property rights
Interfere with or disrupt the platform’s operation
Attempt to reverse engineer or hack any part of OpenSky
Harvest or misuse other users’ information
Impersonate another person or misrepresent your affiliation
We reserve the right to remove content, suspend accounts, or take other actions to address violations of these terms, including violations of intellectual property law, and to respond to valid DMCA takedown requests.
5. Subscriptions and Payments
OpenSky offers free and paid subscription plans. Details of pricing, features, and billing terms are available on our website.
By subscribing to a paid plan, you agree to:
Pay fees based on your selected plan and billing cycle
Provide valid payment information
Allow automatic billing unless canceled
Be responsible for charges until cancellation
6. Cancellations and Refunds
You may cancel at any time from your account settings.
Access will continue until the end of your billing cycle.
We do not offer prorated or partial refunds unless required by law.

7. Data Privacy and Security
Our Privacy Policy (available at openskyplanner.com/privacy) explains how we collect, use, and protect your personal and student information.
By using OpenSky, you agree to the terms of our Privacy Policy, including provisions related to:
COPPA and student data
Parental control over student information
Data retention and deletion rights
Use of cookies and analytics tools
We use industry-standard encryption and access controls to safeguard your data. However, no system is perfectly secure, and you use OpenSky at your own risk.
8. Availability and Uptime
We work hard to keep OpenSky online and functioning. However, we cannot guarantee uninterrupted access.
We may occasionally perform scheduled maintenance or encounter unexpected downtime. We are not liable for any delays, interruptions, or data loss related to outages.
9. Modifications to the Service
We may add, remove, or change features at any time — including free or paid features — to improve OpenSky.
We will notify users if major changes are made, especially those affecting pricing or core functionality.
10. Termination
You may delete your account at any time. This will permanently remove your data from our systems after a short grace period (30 days or less).
We may suspend or terminate your access if you:
Violate these Terms
Abuse the platform or other users
Engage in illegal activity
Fail to pay subscription fees (if applicable)
We will always try to notify you and work toward resolution first.
11. Intellectual Property
All rights to the OpenSky name, logo, software, and interface belong to OpenSky Technologies, Inc. or its licensors.
You may not copy, resell, or distribute OpenSky’s technology or designs without written permission.
Except for the license you grant us in Section 3 for your uploaded content, you retain all rights to your original work.
You may not upload, share, or distribute any content on OpenSky that violates the intellectual property rights of others. We comply with the Digital Millennium Copyright Act (DMCA) and provide a process for rights holders to request removal of infringing material.
12. DMCA Takedown Policy
If you believe that content on OpenSky infringes your copyright, you may submit a takedown notice under the Digital Millennium Copyright Act (DMCA) by providing the following information to support@openskyplanner.com:
Your contact information
A description of the copyrighted work you believe has been infringed
The specific URL or location of the infringing content
A statement under penalty of perjury that you have a good faith belief the use is not authorized
Your physical or electronic signature
Upon receipt of a valid DMCA notice, we will remove or restrict access to the allegedly infringing content and notify the user who uploaded it. Repeat infringement may result in account suspension or termination.
13. Disclaimers
OpenSky is an organizational and planning tool. We do not provide legal advice, academic accreditation, or guaranteed compliance with homeschool laws.
Always check with your local education authorities to ensure you meet legal homeschooling requirements.
We are not liable for your educational outcomes, reporting obligations, or any consequences related to misuse of the platform.
14. Limitation of Liability
To the maximum extent permitted by law, OpenSky Technologies, Inc. is not liable for:
Any indirect, incidental, or consequential damages
Loss of data, income, or business
Disruptions or inaccuracies in your schedule
Actions taken based on projections or pacing tools
In any case, our total liability will not exceed the amount paid by you in the past 12 months, if any.
15. Indemnification
You agree to hold OpenSky harmless from any claims, disputes, or legal action arising from your use of the platform, including:
Your content or curriculum
Student data you submit
Violations of law or third-party rights
Breach of these Terms
16. Governing Law
These Terms are governed by the laws of the State of [Insert State], without regard to conflict of law principles.
Any dispute shall be resolved in the state or federal courts located in [Insert Jurisdiction].
17. Changes to These Terms
We may update these Terms from time to time. If we make significant changes, we’ll notify you by email or in-app notification.
